Welcome to Creators United ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our AI-powered creative services platform, website, and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, then you may not access the Service.

1. Acceptance of Terms

By creating an account, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all visitors, users, and others who access or use the Service.

Creators United provides AI-powered creative services including:

• Branding and identity design
• Pitch deck and presentation design
• AI-based creative assets generation
• Animation and motion graphics
• Project management and collaboration tools
• Credit-based subscription system

3. User Accounts and Registration

• You must be at least 18 years old to create an account
• You are responsible for maintaining the confidentiality of your account credentials
• You agree to provide accurate, current, and complete information during registration
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Subscription Plans and Credits

Subscription Plans

• AI Starter: $700/month with 600 credits and free trial
• AI Pro: $1500/month with 2000 credits
• Enterprise: Custom pricing with unlimited credits

Credit System

• Credits are used to create projects and generate creative assets
• Credit usage varies by project type and complexity
• Credits expire at the end of each billing cycle (except for Enterprise plans)
• Unused credits do not roll over unless specified in your plan
• Credit refunds are subject to our refund policy

Free Trial

• AI Starter plan includes a 30-day free trial
• Trial users can submit up to 2 projects
• Trial automatically converts to paid subscription unless canceled
• No credit card required for trial signup

5. Intellectual Property Rights

Your Content

• You retain ownership of all content you upload or provide to us
• You grant us a license to use your content solely for providing our services
• You represent that you have the right to upload and use all content you provide
• You are responsible for ensuring your content doesn't infringe on third-party rights

Our Content and AI-Generated Assets

• Final approved creative assets become your property upon completion and payment
• We retain rights to our platform, technology, and proprietary methods
• AI-generated content is provided "as is" without guarantees of originality
• You are responsible for verifying that AI-generated content doesn't infringe on third-party rights
• We may use anonymized project data to improve our AI models and services

Platform Content

• All platform content, features, and functionality are owned by Creators United
• You may not copy, modify, distribute, or reverse engineer our platform
• Our trademarks and logos may not be used without written permission

6. User Conduct and Prohibited Uses

You agree not to use the Service:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To spam, phish, pharm, pretext, spider, crawl, or scrape
• For any obscene or immoral purpose
• To interfere with or circumvent the security features of the Service
• To generate content that violates applicable laws or third-party rights
• To attempt to reverse engineer or extract our AI models or proprietary algorithms

7. Payment Terms and Billing

• Subscription fees are billed monthly in advance
• All payments are processed securely through Stripe
• Prices are subject to change with 30 days notice
• Refunds are provided according to our refund policy
• Failed payments may result in service suspension
• You are responsible for all taxes and fees associated with your subscription
• Credits are non-transferable and non-refundable except as required by law

8. Service Availability and Performance

• We strive to maintain 99.9% uptime but do not guarantee uninterrupted service
• Delivery times are estimates and may vary based on project complexity
• We reserve the right to modify or discontinue features with notice
• Scheduled maintenance may temporarily affect service availability
• We are not liable for delays caused by circumstances beyond our control

9. AI-Generated Content Disclaimer

• AI-generated content is provided "as is" without warranties of originality or accuracy
• You are responsible for reviewing and approving all AI-generated content before use
• We do not guarantee that AI-generated content is free from copyright or trademark issues
• You should conduct your own intellectual property searches before using AI-generated content commercially
• We are not liable for any claims arising from your use of AI-generated content
• AI models may be trained on publicly available data and may produce similar outputs for different users

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

• THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS
• WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM
• WE ARE NOT LIABLE FOR ANY LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES

11. Indemnification

You agree to defend, indemnify, and hold harmless Creators United and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

• You may terminate your account at any time by contacting us
• We may terminate or suspend your account immediately for violations of these Terms
• Upon termination, your right to use the Service ceases immediately
• We may retain certain information as required by law or for legitimate business purposes
• Termination does not relieve you of any payment obligations incurred prior to termination

13. Refund Policy

• Free trial cancellations: No charges if canceled before trial ends
• Monthly subscriptions: Refunds may be provided on a case-by-case basis
• Credits: Generally non-refundable once used for project creation
• Unused credits: May be refunded within 30 days of purchase
• Disputed charges: Contact us within 60 days of the charge
• Refund processing: 5-10 business days via original payment method

14. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Service, you consent to the collection and use of your information as outlined in our Privacy Policy.

15. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through:

• Informal Resolution: Contact us first to attempt to resolve the dispute informally
• Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration
• Governing Law: These Terms are governed by the laws of the United Arab Emirates
• Jurisdiction: Any legal proceedings will be conducted in the courts of the United Arab Emirates

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
